Candidate Contract – PAYE – Rolled Up Holiday Pay

 

Definitions and Interpretation

In these Terms the following definitions apply:

  • Actual Rate of Pay –the rate of pay which will be paid for all time worked during an Assignment before the Qualifying Period is completed.
  • Agency Worker – [name and address of Agency Worker] supplied by the Employment Business.
  • Employment Business – Service Care Solutions Limited (Company no. 05381795) of Arthur House, 12-13 Starkie Street, Preston, PR1 3LU.
  • Rolled Up Holiday Pay – Pay due to a worker in respect of leave to which the worker is entitled, paid at the same time as remuneration.

The Contract

These Terms constitute the entire agreement between the Employment Business and the Agency Worker. They govern all Assignments undertaken and prevail over any other terms put forward by the Agency Worker.

Assignments

The Employment Business will endeavour to obtain suitable Assignments. The Agency Worker is not obliged to accept, and the Employment Business is not obliged to offer, any Assignment.

Agency Worker’s Obligations

  • Cooperate with the Hirer’s reasonable instructions.
  • Observe rules and health & safety procedures of the Hirer.
  • Safeguard confidentiality and not engage in conduct detrimental to the Hirer or Employment Business.

Pay and Deductions

The Agency Worker will be paid weekly in arrears for all hours worked at the applicable rate. Deductions will include PAYE and National Insurance contributions.

Annual Leave

Agency Workers are entitled to the statutory minimum annual leave (currently 5.6 weeks). Holiday pay accrues at 12.07% of hours worked and is paid as rolled-up holiday pay.

Sickness Absence

The Agency Worker may be eligible for Statutory Sick Pay (SSP) if the relevant statutory conditions are met. Evidence of incapacity is required.

Termination

An Assignment may be terminated at any time by either party without prior notice or liability, subject to certain conditions.

Confidentiality & Data Protection

The Agency Worker must not disclose confidential information and acknowledges that the Employment Business will process personal data in accordance with Data Protection Laws.
